City Commission (Regular Meeting) Minutes

August 5, 2024, 5:00p.m.
City Hall

I. Call to Order
A. Prayer: Vice Mayor Tom Carter lead the prayer
B. Pledge of Allegiance-lead by Mayor Donna Hernandez

II. Roll Call: All three Commissioners were present

III. Public Comments: Must complete and submit a Public Comment form prior to the start of the meeting. None

IV. Approval of Agenda

V. Approval of Minutes: July 1, 2024: Postponed until the September meeting

VI. Communication from the Mayor

VII. Communication from City Commissioners
A. Vice Mayor Carter discussed concerns with the overflow of recycling bins.
B. Commissioner Howard stated that since the recycling bins belonged to the county, others outside the city may use them.

VIII. Communication from City Manager
A. Fire Department: Russ Gawler was introduced as the new Fire Chief for Baneberry. Fire Chief Gawler discussed the need for a major warranty repair on the Tanker II.
B. Codes Enforcement: CM Phagan stated that he is working with MTAS consultant and legal assistance with code enforcement.
C. Other

IX. Reports from Committees:
A. Planning Commission: Vice Major Tom Carter encouraged residence to let a member of the Planning Commission know of any concerns or issues.
B. Parks & Recreation/Social Entertainment Committee: Residents were reminded of Hawaiian/ Talent night on August 24, 2024.
C. Road Commission-None
D. Board of Zoning Appeals-None

X. Old Business
A. (2nd Reading) Ordinance 2025-01: An Ordinance Amending the Zoning Ordinance of the City of Baneberry to Require Professional Site Plans for all Commercial and Multifamily Development.
Commissioner Howard made a motion to approve Ordinance 2025-01 as written. Vice Major Tom Carter seconded. Passed 3-0.
B. (2nd Reading) Ordinance 2025-02: An Ordinance Revising the Regulations Pertaining to Minimum Square Footage of Single-Family Homes. Commissioner Howard made a motion to approve Ordinance 2025-02 as written. Vice Major Tom Carter seconded. Passed 3-0.
C. Review and recommend additional updates to ordinances and codes related to building, site development/improvement, zoning, subdivision, and roads.

XI. New Business
Ordinance 2025-03: An Ordinance Adding a Clause to the C-1 District Referring Determination of Similar Use to the Board of Zoning Appeals and Clarifying Prohibited Use(s)
Vice Mayor Tom Carter made a motion to approve Ordinance 2025-03 as written. Commissioner Mark Howard seconded. Passed 3-0

Commissioner Mark Howard made a motion to adjourn. Vice Mayor Tom Carter seconded. Passed 3-0.
